Does the state have a law defining DPC as outside insurance regulation?
No statute, and no bill has been introduced.
The phrase "direct primary care" appears nowhere in the Delaware Code. The General Assembly's bill database returns no bill containing it in any session it holds, from 1998 to 2026. Both searches were confirmed to be working with a control term first.

None found. One nearby provision is easy to misread.
Delaware's discount medical plan law excludes "Any physician or group of physicians or contracts regulated by the Board of Medical Licensure and Discipline" from the definition of a discount medical plan. That keeps a practice out of the discount plan registration rules. It does not say whether a membership is insurance under Title 18, and we found no Department of Insurance bulletin that does. The general test for the business of insurance applies to your agreement as written.
