Does the state have a law defining DPC as outside insurance regulation?

No bill found in the 2024-2025 or 2026-2027 sessions.

That index covers bill titles and synopses, not the full text of every bill. A bill search cannot show whether a law was passed before 2024, and we have not searched the statutes themselves.

We found no Department of Banking and Insurance bulletin or opinion on whether a private membership agreement is insurance. The Department publishes bulletins in several series and our search may not have reached all of them. The Maryland page shows how one regulator reasons through the question.

State HSA treatment

Whether the state follows the federal HSA rules for DPC

Not stated by the state. The 2025 NJ-1040 medical expenses worksheet has a line for Archer medical savings account contributions and none for health savings accounts.

The Division of Taxation's exempt income page (nj.gov/treasury/taxation/njit12.shtml) lists "Contributions to and distributions from Archer MSAs if they are excluded for federal income tax purposes", and its deductions page, linked below, says "New Jersey follows the federal rules for deducting qualified Archer MSA contributions." Health savings accounts are not mentioned on either page, in the 2025 NJ-1040 instructions, or in any of the Division's technical bulletins. We found no Division of Taxation document that says outright how contributions are treated. Ask a New Jersey tax professional before you tell members that fees paid from a health savings account are free of state tax.
